This license agreement is between Parkinson Voice Project, Inc. (listed below as “Parkinson Voice Project”) and SPEAK OUT! Providers. This agreement replaces any and all previous agreements.
A “SPEAK OUT! Provider” is defined as a speech-language pathologist who has completed formal SPEAK OUT! Therapy Training and Licensing through Parkinson Voice Project. Clinicians who attend other educational offerings by Parkinson Voice Project or who complete SPEAK OUT! Therapy training as students are not SPEAK OUT! Providers and are not entitled to any of the benefits listed in this agreement.
SPEAK OUT! Providers understand and agree Parkinson Voice Project is the sole creator and owner of the worldwide intellectual property rights of the SPEAK OUT! Therapy Program and all its courses and accompanying therapy materials and videos, including but not limited to SPEAK OUT! Workbooks and eLibrary, Circle of Intent, What is Parkinson’s? video, and Online SPEAK OUT! Home Practice Sessions.
SPEAK OUT! Providers understand and agree Parkinson Voice Project is a nonprofit organization that spent considerable time, donor funds, effort, resources, and goodwill to develop the SPEAK OUT! Therapy Program and all its accompanying therapy materials and videos and is offering this license to help more people with Parkinson’s have access to quality speech treatment.
SPEAK OUT! Providers understand and agree this license must be renewed annually; otherwise, all benefits of this license will be suspended until the license renewal is completed.
SPEAK OUT! Providers also understand and agree if they or the entity for which they are providing speech therapy services violates any of the terms listed in this agreement, Parkinson Voice Project will suspend the SPEAK OUT! Provider’s license until these guidelines are met.
Benefits of this License:
- Licensed SPEAK OUT! Providers and their patients have access to SPEAK OUT! Program materials (e.g., SPEAK OUT! Workbooks and/or the eLibrary). SPEAK OUT! Workbooks are not shipped outside the U.S.
- Licensed SPEAK OUT! Providers may participate in the SPEAK OUT! Providers Facebook group and enjoy other future benefits that may be offered.
- Licensed SPEAK OUT! Providers may identify themselves as “Licensed SPEAK OUT! Providers.”
- Licensed SPEAK OUT! Providers may be listed on the referral page of Parkinson Voice Project’s website.
- Licensed U.S. SPEAK OUT! Providers may order SPEAK OUT! Therapy marketing brochures at no cost from Parkinson Voice Project. We cannot ship brochures outside the U.S.
- Licensed SPEAK OUT! Providers may apply for grants.
- Licensed SPEAK OUT! Providers may identify the therapy/treatment they are providing as “SPEAK OUT! Therapy,” or the “SPEAK OUT! Therapy Program” as long as Parkinson Voice Project’s protocol is strictly followed.
- Licensed SPEAK OUT! Providers may promote and market their use of the SPEAK OUT! Therapy Program, but they must include a statement in any written materials, publications, or media interviews acknowledging that the program was developed by Parkinson Voice Project. Below is an example of how to describe the SPEAK OUT!® Therapy Program and credit Parkinson Voice Project:
The SPEAK OUT!® Therapy Program, developed by Parkinson Voice Project, helps people with Parkinson’s and related neurological disorders regain and retain their speech and swallowing. Using the principles of motor learning, this evidence-based program combines education, a specialized workbook, individual and group speech therapy, daily home practice, and regular follow-ups. SPEAK OUT! Therapy trains patients to “speak with INTENT,” transitioning speech from an automatic function to an intentional act.
Limitations and Restrictions of this License:
- Licensed SPEAK OUT! Providers may not use the SPEAK OUT! Therapy logo or create any trademark confusingly similar to this logo. If you currently have the SPEAK OUT! Logo on your website or any other materials, it must be removed.
- Licensed SPEAK OUT! Providers may not use the Parkinson Voice Project logo or create any trademark confusingly similar to this logo. If you currently have the Parkinson Voice Project Logo on your website or any other materials, it must be removed.
- Licensed SPEAK OUT! Providers may not use the names or logos of “The LOUD Crowd®” or “SING OUT!®” If you currently have these names or logos on your website or any other materials, they must be removed.
- Licensed SPEAK OUT! Providers may not copy, snip, edit, or alter any SPEAK OUT! Therapy Program therapy materials or training course content.
- Licensed SPEAK OUT! Providers may not create, translate, or publish any SPEAK OUT! Therapy materials or materials that resemble SPEAK OUT! Therapy materials without written permission from Parkinson Voice Project.
- Licensed SPEAK OUT! Providers may not independently create, publish, or promote videos that resemble Parkinson Voice Project’s Online SPEAK OUT! Home Practice Sessions.
- Licensed SPEAK OUT! Providers may not use SPEAK OUT! Therapy materials for fundraising purposes without written permission from Parkinson Voice Project.
- Licensed SPEAK OUT! Providers may not take any action that may confuse patients, families, or consumers as to their relationship with Parkinson Voice Project. This includes using the words “Parkinson Voice” or “Parkinson Voice Project” or “Parkinson’s Voice” or “Parkinson’s Voice Project” or “PVP” in its business names, logos, programs, email addresses, or in any other fashion.
- Licensed SPEAK OUT! Providers must not take any action that makes it appear they are employees, agents, partners, joint venturers of, or in any way affiliated with Parkinson Voice Project, other than having received training from Parkinson Voice Project or having received a grant from Parkinson Voice Project. Being a Licensed SPEAK OUT! Provider does not imply the Provider is a trainer of the program.
- The universities that have been selected as “SPEAK OUT! Therapy & Research Centers” should use the term “collaborates” when describing the relationship between their university and Parkinson Voice Project. They must not take any action that makes it appear they are employees, agents, partners, or joint venturers of Parkinson Voice Project.
License Suspension or Revocation:
- Parkinson Voice Project has the authority to suspend or revoke a SPEAK OUT! Provider License for violation of any of the above guidelines or for any other reason it deems appropriate.
- If a SPEAK OUT! Therapy License has been suspended or revoked, Parkinson Voice Project will notify the SPEAK OUT! Provider by phone or email (using the contact information the organization has on file). Depending on the violation, an opportunity may be provided to remedy the situation and for the license to be reinstated.
- When a license is suspended or revoked, SPEAK OUT! Providers will not be able to order workbooks or eLibrary access for patients and will lose their access to the SPEAK OUT! eLibrary and Clinical Resources. They may not identify themselves as Licensed SPEAK OUT! Providers. They will not be able to apply for grants. Their referral information will be removed from Parkinson Voice Project’s website, and they are required to remove any SPEAK OUT! Therapy promotional information from their website. In addition, they will be removed from the SPEAK OUT! Providers Facebook Group and will lose any and all other benefits of the license.
